Lindsay Clancy attorney wants holdout juror investigated

An attorney for Lindsay Clancy is requesting that a judge probe the conduct of the juror who contends that the mother should be convicted of murder in the deaths of her three young children in Massachusetts.
In a motion filed on Sept. 18, Clancy’s lawyer, Kevin Reddington, asked the court to question juror Michael Desronvil about his alleged use of a cellphone during deliberations, his truthfulness on a questionnaire that prospective jurors filled out before the trial started and his truthfulness when jurors were questioned by the judge a day before the trial ended.

The Associated Press reported that Reddington also asked the court to obtain a record of any calls or texts Desronvil made between 8 a.m. and 4:30 p.m. on each day the jury deliberated. Phone use during deliberations is prohibited in Massachusetts.

The backstory:
On Sept. 4, a judge declared a mistrial after the jury couldn’t reach a unanimous verdict. The AP reported that 11 of 12 jurors were ready to clear Clancy of criminal responsibility, with the majority believing that she was dealing with a rare condition called postpartum psychosis when she strangled her kids.
However, Desronvil sided with the prosecutors in the trial, who argued that Clancy knew what she was doing.
Clancy’s lawyer, Kevin Reddington, asked President Donald Trump to intervene in the case, seeking a pardon even though the charges were brought under state law.

Lindsay Clancy will continue to be held at the Tewksbury State Hospital. The case will go back to the same status as before the trial, with Clancy charged with murder and being held at the psychiatric hospital and waiting for a resolution of the criminal case against her.

Judge William Sullivan scheduled a status hearing for Sept. 29, and prosecutors indicated in court Friday that they would ideally like to retry the case later this fall, although no definitive timetable has been set.
Prosecutors will have to decide whether to try her again with a new jury. If they proceed with a new trial, the jury selection process will begin again, and a new trial will be scheduled.
