CENTURY CITY, Calif. (FOX 11) - Nearly two months after the Las Vegas mass shooting, about 450 victims are now part of a major lawsuit that claims the venue and security didn’t do enough to keep them safe.
“Certainly they didn’t know they would have an evil act such as this, but they could have anticipated it,” attorney, Chad Pinkerton, said.
The lawsuit filed in California Superior Court names MGM Resorts International, the parent company of Mandalay Bay, Live Nation Entertainment and the concert security company Contemporary Services Corporation.
“The security was an utter failure,” Pinkerton said.
Lawyers believe had better security been in place at the hotel, shooter Stephen Paddock, could have been caught before the massacre.
“Hallway cameras would be important in a case like this,” Pinkerton said. “They could have identified the perpetrator moving in and out of his hotel room and what he was taking into his hotel room.”
Pinkerton alleges MGM ignored industry protocol when it comes to active shooter situations.
He also said, there was no clear evacuation plan for concert-goers once the shooting started and he said that lead to chaos and people being trampled.
“There were no clearly marked exit signs for people to leave,” attorney, Muhammad Aziz, said. “The exits that were there, some of them were actual exits, but they were blocked off.”
The injuries suffered by plaintiffs in the lawsuit range from shooting injuries to trampling injuries to PTSD cases.
Lawyers said they would be satisfied with at least a billion dollars in damages for the victims and they hope the lawsuit will lead to major security changes at large concerts.
Four other lawsuits were also filed on behalf of families of deceased victims and victims with major injuries.
Lawyers decided to file in California because 65 percent of their clients live in the state.
They are hoping to have a trial date set within the next 18 months.
Contemporary Services Corporation sent FOX 11 a statement that said the company doesn’t comment on pending litigation.
MGM Resorts International has said in the past it wouldn’t comment on litigation out of respect to the victims.
