A police body camera captured the entire incident. It appears to show a Barstow police officer wrestling Cooks to the ground. At the time, she was eight months pregnant.
It all started with a phone call from a woman claiming Cooks had road rage at an elementary school parking lot. When police spoke to the person making the call, the officer tells her there is no crime.
He then asks Cooks for her identification. When she refused, the officer then proceeded to arrest her. Cooks was charged with resisting arrest, but a judge later dismissed those charges. Since then, Cooks gave birth to a baby girl and hired attorney Caree Harper.
"The officer clearly said, 'there's no crime.' You can't arrest someone if the officer says there's no crime. It was unconstitutional," Harper said.
The Barstow Police Department is defending the officer saying he acted properly.
